GCHN.DE maintains Internet services that enable natural persons to use the services made available on this website.

The website has no commercial interests and is run by private individuals in their free time. We make every effort to protect the copyrights of others! Therefore, a legal dispute with GCHN.DE in such matters is neither appropriate nor necessary. Should anyone see their own rights or those of another violated by us, a simple e-mail to webmaster@gchn.de is sufficient to remedy such a defect!

Users of the GCHN.DE website are not consumers within the meaning of the law.

By using the Internet services of GCHN.DE, visitors and users (hereinafter referred to as "users") agree to the terms of use formulated here. By only partially using this website, users confirm their knowledge, declare their consent and agree to the General Conditions of Use. Partial use of a website occurs as soon as it is called up in a stationary or mobile internet browser.

If users do not agree to the General Terms of Use, they must not use the website. If users do not agree with even just parts of these terms of use and still use the services/features of the website, they release the authors/responsible persons/vicarious agents from any legal responsibility within the meaning of the applicable legal regulations.

Deviating conditions of the user, which are in conflict with these general terms of use, will not be taken into account under any circumstances, unless GCHN.DE agrees to them in writing.

Supplements regarding the use of special services that require registration at GCHN.DE become legally effective as soon as the user has successfully registered at GCHN.DE. A successful registration comes about when the personal GCHN account data is sent to the user by email.

These general terms of use are the basis of any action on GCHN.DE. They remain valid even if no separate reference is made to them when other services are used.

GCHN.DE is entitled to commission third parties to provide parts or the entire range of services. In this case, these Terms of Use also apply.

GCHN.DE reserves the right to change these Terms of Use at any time. Registered users will be informed of any changes in the forum. If the user does not agree to the new conditions, he may no longer register on GCHN.DE and must send an email to  user administration@gchn.de  to request the deletion of his account. With the first registration after notification, the user agrees to the changed conditions.

2. Scope of Services

GCHN.DE is used for the exchange of opinions, the procurement of information and the search for / maintenance of contacts by geocachers who have an active account with GEOCACHING.COM (GC) or OPENCACHING.DE (OC). We should all enjoy using it. We therefore ask you to read the following terms of use carefully and only join the forum if you fully agree to them. By joining GCHN.DE you accept all of the following rules:

Joining the forum is only possible with an active GC account and you can only be registered at GCHN.DE with your GC or OC account name. Deviations from this rule are only possible if components of the GC or OC name, eg certain special characters, are not accepted by the GCHN server (eg "+" instead of "&"). The validity and authenticity of your GC or OC account is checked by the GCHN user administration in a suitable manner, eg by asking questions in the forum community. Registration with a GC or OC second account is also not permitted. If the identity of a GC or OC account cannot be determined without a doubt, registration with GCHN.DE is not possible. 
 
Note that you must not share your password with anyone who is not part of your GC or OC team. Each user is only permitted to access and/or use the forum with their own access data, but not with third-party access data.

Note that the forum operators are not responsible for the content. Despite all precautions, security devices and good intentions, we do not guarantee the identity of the authors, the correctness and usability of content of any kind. All content does not necessarily reflect the opinions of the forum operators.

It is not permitted to use this forum and its contents for commercial purposes outside of the forum areas expressly marked for this purpose without the express written consent of GCHN.DE. If it becomes apparent to the moderators that a forum is being used primarily for promotional purposes, even indirectly, they will remove the offending links from threads or signatures.

Advertising within the "commercial" corners of GCHN.DE is only permitted to selected members who actively participate in forum life and thus contribute to the success of a high-quality forum community. The advertised offers must also represent significant added value for a majority of forum users.

We wish that this forum is characterized by a certain level. Therefore, give your discussion partners in the forum the respect they deserve by choosing the right words, spelling them as correctly as possible and being courteous. Personal hostility, disparagement and amusement at the expense of other forum participants are expressly undesirable. Always treat your interlocutors in a friendly manner and remember that new users in particular sometimes have a hard time finding your way around with us and also answer questions that someone has already asked, either in a friendly manner or rather not at all! Our users are looking for answers to their questions, not lectures! Always act according to the principle: We are the friendly forum where the sun always shines! The administrators and moderators pay close attention to the tone of the forums and intervene if necessary.

For reasons of clarity in our well-frequented forum, posting multiple topics (threads) on the same content is not desired! Always use the search function before creating a new thread to ensure that this thread already exists! Threads that have been inactive for a long time also move up to the top with each new post and are noticed by the forum members!

The forum operators have the right to delete topics or posts without giving a reason. This applies in particular if there are violations of the terms of use formulated here.

Instructions from moderators should be the exception in a forum. GCHN.DE makes every effort to keep these to a minimum. If the moderators intervene anyway, there will be good reasons for it! The instructions of our moderators, acting on behalf of GCHN.DE, are to be observed and not a basis for discussion!

As part of their voluntary work at GCHN.DE, the moderators and experts pass on their knowledge to other members free of charge. By using GCHN.DE and in particular by using the assistance/advice, you release all moderators and experts from any conceivable liability.

The personal data stored during registration will not be passed on to third parties by GCHN.DE. The transmitted e-mail address is only used by GCHN.DE for the operation of the forum and cannot be viewed by the forum users. Only the personal data voluntarily provided in the profile can be viewed by registered users.

By joining GCHN.DE you agree not to post any topics, posts, links, etc. in the forum that are untrue, contain slander, hatred, violence, pornography or threats that are obscene or violate the privacy of others , other groups, minorities, etc., discriminate against good morals or existing laws. You also declare that you will not violate any trademark and/or copyright law and that you will refrain from spamming, flooding, advertising messages, chain letters, advertising for any form of pyramid schemes, pyramid schemes, etc. This information also applies to the choice of your member name and to any photos and drawings placed in your profile and/or postings.

All prohibitions also apply to any references, links etc. in the signature.

Since the forum is not continuously monitored, rule violations may not be removed immediately. We therefore assume no responsibility for the content of the users of our forum. Every user is responsible for their own activities in the forum and may release the forum operator from their liability.

GCHN.DE reserves the right to temporarily or completely withdraw the write authorization from participants, to block accounts or to permanently deny users access to the forum without explicitly stating reasons. This applies not only to violations of the usage regulations, but also to repeated violations of the general forum peace. Corresponding cases are logged internally for any necessary proof. In the case of particularly serious violations, GCHN.DE reserves the right to take further legal measures.

If a member is banned from the forum, they are prohibited from re-registering without GCHN.DE's express consent. He is also prohibited from participating in the forum life in any way using a third-party account. A violation can lead to criminal charges for trespassing and coercion, as well as possible claims for damages.

These conditions apply to the entire offer of GCHN.DE, all open and all closed forum parts. They can be changed and adjusted at any time.

The user can add personal information, descriptions, photos, etc. within his profile, which are helpful for communication with other users. GCHN.DE reserves the right to take civil legal action and to delete the account immediately after it becomes aware of incorrect information made intentionally or with fraudulent intent in the profile or in other areas of the portal

A user can email himself at any time without giving a reason  user administration@gchn.de  unsubscribe from GCHN.DE. The corresponding GCHN account will then be deleted.

3. Data Use and Privacy

By registering with GCHN.DE, the user agrees to the following regulations for the use of his personal information.

GCHN.DE always observes the statutory data protection regulations. In compliance with these legal provisions, data is collected and used as follows:

GCHN.DE collects, uses and analyzes the member's personal information in various ways in different places on its own websites and other services operated by its own and partners in order to enable the Internet services to function and to be able to offer users a good service. This information is created by providing information about the user and by using the services offered. The user agrees that his personal data will be stored in electronic form.

GCHN.DE is entitled to pass on pseudonyms of users to other members, which enables a personal exchange of messages between users. However, the pseudonyms do not reveal the identity (name, address, telephone number, e-mail address) of the respective user.

GCHN.DE endeavors to ensure the proper operation of the service, but cannot guarantee the uninterrupted usability or accessibility of the service. Liability for technically caused transmission delays or failures is excluded.

GCHN.DE expressly reserves the right to change, supplement or delete parts of the pages or the entire offer or to temporarily or permanently cease publication without prior notice.

GCHN.DE is not liable for the unauthorized acquisition of knowledge of personal user data by third parties (e.g. through unauthorized access by third parties). GCHN.DE is not obliged to check content, information, image files, text content or similar from users, but reserves the right to check, change or delete content, e.g. B. in the case of recognizable presence of incorrect information.

5. User Obligations

The respective user is responsible for any legally required business registrations.

The user assures GCHN.DE that he is of legal age.

The user is solely responsible for the content of his registration and thus for the information he provides about himself. He assures that the data he has provided is true. By registering with GCHN.DE, the user assures that he will only use GCHN.DE for private, non-commercial purposes and, in particular, will treat the information entrusted to him by other members confidentially and will not use it for commercial purposes.

The user undertakes to keep GCHN.DE free from any kind of costs, lawsuits, damages, losses or other claims that may arise from his registration or participation in GCHN.DE services. The user undertakes, in particular GCHN.DE, from any liability and from all obligations, expenses and claims resulting from damage due to insult, slander, violation of personal rights, due to the failure of services for other members, due to the violation of intellectual property or other rights arise. The indemnification obligation also relates to the costs required to defend against such claims.

The user is obliged to treat e-mails and other messages confidentially and only make them accessible to third parties with the express prior consent of the sender. This also applies in particular to names, telephone and fax numbers, address data, e-mail addresses and URLs.

Furthermore, the user undertakes not to misuse the services of GCHN.DE, in particular:
 

• not to distribute any defamatory, offensive or otherwise unlawful material or information. In particular, this applies to pornographic, racist, hate speech or similar - including obscene - content.

• not to harass, threaten other users or violate the rights (including privacy rights) of third parties

• not to bring any data into the system that contains a computer virus (infected software) or software or other material that is protected by copyright, unless the user himself has the rights to it, the necessary consents for this and any damage is excluded.

• not to intercept or attempt to intercept e-mail from other users.

• no serial/chain letters to be sent

Failure to comply with the obligations may result in immediate exclusion from GCHN.DE and civil and criminal penalties for the user. In particular, GCHN.DE reserves the right to exclude users who, when using GCHN.DE Internet services, disseminate immoral, politically radical or obscene content or photos.

The user declares that he will not use the data entrusted to him by third parties for commercial purposes and/or associate his registration with commercial interests.

6.Copyright

If you create a contribution on GCHN.DE, you grant GCHN.DE a free right, unlimited in terms of time and space, to publish or delete this contribution in full, modified or only in part, and to do so within the scope of the activities of GCHN.DE use. This right of use is irrevocable and remains in effect even after you have finally logged out of GCHN.DE. The above also applies to the same extent for uploaded or released image and sound documents.

GCHN.DE endeavors to protect the copyright rights of third parties in all Internet services. Therefore, GCHN.DE also claims all copyrights for any self-created content on its website. GCHN is a registered trademark. Reproduction or use of content of any kind including the GCHN symbols is only permitted with the express written consent of GCHN.DE.
 

Exceptions:

Use of the GCHN symbols and script for personal use only in:

• official cache listings at GEOCACHING.COM, OPENCACHING.DE or TERRACACHING.COM

• personal profiles at GEOCACHING.COM, OPENCACHING.DE or TERRACACHING.COM

• personal log stamps

• Stamp your own letterboxes

• in personal letterheads, signatures, business cards or logbooks

• on personal name tags and the name tags of visitors to an event

as long as they are not changed and the reference to GCHN.DE or "Geocacher Hoher Norden" is recognizable. However, these exceptional circumstances do not apply if the above items are not manufactured for personal use but for commercial distribution.

The use of the GCHN symbols and lettering is permitted on textiles of all kinds if they are obtained from a sales partner authorized by GCHN.DE (currently  Nordstick ). Any changes to the templates require the approval of GCHN.DE and cannot be discussed directly with the sales partner.

7. Jurisdiction, Severability Clause

The law of the Federal Republic of Germany is exclusively applicable to these General Terms and Conditions/Terms of Use and all other agreements between users and GCHN.DE. Place of jurisdiction is Schleswig.

Should individual provisions of these conditions be or become ineffective in whole or in part, this shall not affect the validity of the remaining provisions. Should individual provisions be ineffective in whole or in part or lose their effectiveness at a later point in time, this shall not affect the validity of the remainder. The parties shall replace the ineffective provision with an effective one that corresponds as closely as possible to the purpose of the ineffective provision. The same applies to any gaps.
